1. General provisions
These Terms and Conditions (the “Terms”) are applied by IONIOS – TURISTIČKA AGENCIJA d.o.o., Obala kralja Krešimira 5, 21480 Vis, Croatia, OIB: 38583339045, MBS: 060155654 (the “Agency”). The Terms apply to all services the Agency provides directly to customers: organised boat and vehicle excursions and transfers, rental of cars, bicycles, scooters, boats and kayaks, intermediation in accommodation services, and the sale of other services and products offered by the Agency. By making a reservation or using a service, the customer confirms that they have read and accepted these Terms.
2. Reservations and conclusion of contract
Reservations can be made in person at the Agency office, by phone, by e-mail or via the website. A reservation is confirmed when the Agency issues a booking confirmation, i.e. when the customer pays a deposit of 50 % of the service price. For certain services (e.g. vehicle and boat rental), the customer must present a valid identification document upon pick-up, and for vehicle rental also a valid driving licence of the appropriate category.
3. Prices and payment
Service prices are published at the Agency office and on the website, are expressed in euros (EUR) and include VAT where applicable. The Agency reserves the right to change published prices; for confirmed reservations, the price valid at the time of booking applies. Payment is possible in cash or by card.
4. Cancellation by the customer
The customer may cancel a reservation in writing (by e-mail) or in person at the Agency office. The following cancellation terms apply:
- cancellation up to 1 day before the start of the service – full refund,
- cancellation 24 to 12 hours before the start of the service – the Agency retains 50 % of the price,
- cancellation less than 12 hours before the start of the service, or no-show – the Agency retains 100 % of the price.
5. Cancellation or changes by the Agency
The Agency may cancel or modify a service (in particular boat excursions and transfers) due to weather conditions, sea state, force majeure or an insufficient number of registered passengers, and will notify the customer without delay. In such cases the customer is entitled to an alternative date or a full refund of the amount paid, without the right to further compensation.
6. Vehicle and boat rental
The customer must use the rented vehicle, boat or equipment with due care, in accordance with regulations and the Agency’s instructions, and return it in the condition in which it was received, with the agreed amount of fuel. The customer is liable for damage caused by their fault that is not covered by insurance. A deposit as per the price list may be required at pick-up. Boat rental is permitted only to persons who meet the legal requirements for operating a boat, where prescribed for the vessel in question.
7. Obligations and liability of the Agency
The Agency undertakes to provide services in accordance with the published conditions, content and price, and with professional care. The Agency is not liable for damage caused by force majeure, by the customer acting contrary to instructions or regulations, or for services of third-party providers where the Agency acts solely as an intermediary, in which case the terms of that service provider also apply.
8. Obligations of the customer
The customer must arrive at the agreed departure point on time, hold valid documents, follow the instructions of the Agency, tour leader or crew, and is liable for damage caused by their own conduct.
9. Personal data protection
The Agency collects and processes customers’ personal data to the extent necessary to provide the service, in accordance with the General Data Protection Regulation (GDPR). Detailed information is available in the Privacy policy. Everything the Agency learns about a traveller is kept as a business secret in accordance with the Croatian Act on the Provision of Tourism Services.
10. Complaints
Written complaints may be submitted in person at the Agency office, by post to the registered address, or by e-mail to ionios.agency@gmail.com. The Agency will respond in writing within 15 days of receipt. Detailed instructions are provided in the Legal notice.
11. Governing law and jurisdiction
These Terms are governed by the law of the Republic of Croatia. For disputes that cannot be resolved amicably, the competent court in Split shall have jurisdiction.
12. Final provisions
These Terms are published on the website and at the Agency office and apply as of 1.1.2024. The Agency reserves the right to amend the Terms; contracts are governed by the Terms valid at the time of booking.
